Acceptance of these Terms
These Terms of Use govern your access to and use of the apps, websites, and related services provided by Better Day Wireless, Inc. (collectively, the “Services”). By accessing or using a Service, you agree to these Terms. If you do not agree, do not use the Services. Additional terms presented for a particular app, purchase, or feature also apply.
Using our apps and services
Use the Services only for lawful purposes. Do not interfere with their operation, attempt to gain unauthorized access to an app, account, server, or network, introduce malicious code, circumvent security or access restrictions, misuse sharing features, or use the Services in a way that infringes the rights of others.
Intellectual-property ownership
The Services, including their software, designs, graphics, audio, text, documentation, trademarks, and content provided by Better Day Wireless, are owned by Better Day Wireless or its licensors and are protected by intellectual-property laws. Subject to these Terms, Better Day Wireless grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the Services for personal, noncommercial purposes. Except where the law expressly permits it, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services without written permission. Third-party content remains the property of its respective owners.
Your content
You retain ownership of content you create. If you choose to upload, transmit, or share content through a Service, you grant Better Day Wireless a limited license to host, process, reproduce, and transmit that content only as needed to provide, secure, and support the feature you selected. You are responsible for having the rights needed to use and share that content. Anyone who receives a shared link may be able to forward it, so share links only with people you trust.
Purchases and subscription prices
Some apps offer optional purchases or auto-renewing subscriptions. Available features, prices, billing periods, and any trial or introductory offer are shown in the app and by Apple before you confirm a purchase. Prices and offers can vary by app, plan, and storefront. Refer to the offer Apple displays for your purchase rather than a fixed price on this website.
Billing and renewal
Apple bills your Apple Account for App Store purchases. An auto-renewing subscription renews according to the terms presented at purchase unless you cancel it through your Apple Account subscription settings. Any trial or promotional period is subject to the terms Apple displays for that offer.
Managing and canceling subscriptions
On iPhone or iPad, open Settings, tap your name, select Subscriptions, choose the subscription, and select Cancel Subscription. Cancellation stops future renewal and does not normally end access before the paid period expires. If you do not want a free or discounted trial to renew, follow the cancellation deadline shown by Apple; Apple advises canceling a trial at least 24 hours before it ends.
Apple’s purchase terms
App Store downloads, purchases, subscriptions, and refund requests are also governed by Apple’s applicable terms and policies. If these Terms conflict with terms Apple requires for an App Store transaction, Apple’s applicable transaction terms control for that transaction.
Content and availability
Features and available content differ between apps and may change as licensing, technical, product, or legal requirements change. We may modify, suspend, or discontinue a Service or feature. The purchase offer and any app-specific terms describe the access included with a particular purchase or subscription.
Disclaimer of warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Better Day Wireless does not warrant that the Services will always be available, uninterrupted, secure, or error-free, or that content will never be lost. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
Limitation of liability
To the maximum extent permitted by law, Better Day Wireless and its officers, directors, employees, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or use, arising from or related to the Services. Their total liability for all claims arising from or related to a Service will not exceed the greater of US $100 or the amount you paid for that Service during the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot lawfully be excluded or limited.
Termination
You may stop using the Services at any time. Better Day Wireless may suspend or terminate access if you violate these Terms, create a security or legal risk, or if a Service is discontinued. Where practical, we will provide notice. Termination does not cancel an App Store subscription; manage subscriptions through your Apple Account. Provisions that by their nature should survive termination—including intellectual-property, warranty, liability, governing-law, and dispute provisions—will survive.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Mandatory consumer protections available under the laws of your place of residence remain unaffected.
Dispute resolution
Before filing a legal claim, you and Better Day Wireless agree to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice is sent to support@betterdaywireless.com. If the dispute is not resolved, any legal proceeding must be brought in the state courts located in Travis County, Texas, or the United States District Court for the Western District of Texas, and each party consents to those courts’ jurisdiction and venue. This provision does not prevent either party from bringing an eligible claim in small-claims court or exercising rights that cannot be waived under applicable consumer law.
Changes to these Terms
We may update these Terms as our apps, services, or legal obligations change. The current version and effective date will be posted on this page. Where required by law, we will provide additional notice. Your continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms to the extent permitted by law.
